O-1-Visas: Persons Of Extraordinary Ability

The O-1 visa is designed for individuals with extraordinary abilities or accomplishments who seek to temporarily reside and work in the United States. This visa is granted to those who exhibit exceptional skill in fields such as science, arts, education, business, or athletics, including those who have achieved notable recognition in the motion picture or television industries, either nationally or internationally.

O-1A Visa Qualifications:


For eligibility under the O-1A visa, the applicant must demonstrate extraordinary ability in the sciences, education, business, or athletics. This can be shown by providing evidence of either a major internationally recognized award, such as a Nobel Prize, or by meeting at least three of the following criteria:


  • Receiving nationally or internationally recognized awards or prizes for excellence in their field.
  • Membership in associations that require outstanding achievements, as determined by experts of national or international repute.
  • Publication of significant materials about the applicant and their work in major professional or trade journals, newspapers, or other prominent media.
  • Demonstrating original contributions of substantial significance in their field of science, scholarship, or business.
  • Authoring scholarly articles in professional journals or major media pertinent to their area of expertise.
  • Earning a high salary or remuneration for their services, supported by contracts or credible evidence.
  • Serving as a judge or panelist evaluating the work of others in the same or related fields.
  • Holding a critical or essential position for prestigious organizations or establishments.

Alternative evidence and documentation can also be provided to substantiate these criteria.


O-1B Visa Qualifications:


The O-1B visa is for individuals with extraordinary achievements in the arts, motion picture industry, or television field. To qualify, the applicant must either have received or been nominated for significant national or international awards or prizes, or meet at least three of the following criteria:

  • Leading or starring in productions or events that have a distinguished reputation, supported by critical reviews, contracts, or endorsements.
  • Gaining national or international recognition for achievements, evidenced by critical reviews or published materials about the applicant in major newspapers, trade journals, magazines, or similar publications.
  • Holding a leading, starring, or critical role in organizations or establishments with a distinguished reputation, as demonstrated by articles, testimonials, or publications.
  • Achieving major commercial or critical successes, shown by metrics such as titles, ratings, box office receipts, or notable achievements reported in trade journals or major newspapers.
  • Receiving substantial recognition from respected organizations, critics, government agencies, or experts, with testimonials demonstrating the authority and expertise of the source.
  • Earning a high salary or substantial remuneration compared to others in the field, supported by contracts or reliable evidence.

Comparable evidence and supporting documentation may be used to support these criteria. In both O-1 visa categories, the aim is for individuals with extraordinary abilities to temporarily enter the U.S. to continue their work in their field of exceptional achievement.


O Category Family Visas:


Family members of O visa holders can accompany or join the principal applicant in the U.S. under the O-3 visa category. However, those with O-3 status are not permitted to work in the U.S. but are allowed to engage in educational studies.
